Akbar Moqadar arrived in Ireland from Afghanistan in 2018. Four years later, a woman with an intellectual disability entered a Co Clare swimming-pool steam room and encountered a stranger who refused to accept her refusal. A Central Criminal Court jury found that Moqadar pushed her head towards his exposed penis and orally raped her.

The offence

Moqadar exposed himself, instructed the woman to perform oral sex and used his hand to push her head towards his penis when she refused. He continued as she tried to pull away and briefly blocked her exit. She sought help from a lifeguard immediately and disclosed the rape to a social worker the next day. CCTV recorded movements outside the room and Gardaí obtained Moqadar’s details from the pool.

In interview, he first said the encounter was consensual, then changed his account to no physical contact. A jury convicted him in December 2025 of one count of oral rape under section 4. He continues to deny the offence, but the conviction is final unless overturned by a court.

Sentence

Mr Justice Patrick McGrath selected an eight-year headline, reduced it to seven to reflect the difficulties of a foreign national serving imprisonment in Ireland, and suspended the final 12 months. That left six years’ immediate custody, backdated to December 2025, with Probation Service supervision after release.

The court did not find that Moqadar knew of the woman’s intellectual disability. He had one previous minor, unrelated conviction in France; its offence, date and sentence were not published.

Immigration facts and gaps

Moqadar came from Afghanistan in 2018 and had been working in Ireland. Reporting does not establish whether he arrived as an asylum applicant, refugee, visa holder or under another permission. Defence said he would be willing to return to Afghanistan if a part-suspended term were conditioned on doing so, but no such condition or deportation order was reported.
